Terms and Conditions

1. Bidder Registration: The auction is open to the public and your attendance is welcomed. A personal or cashier's check with proper identification (i.e. Driver's License) will be accepted. Please come prepared to participate in the auction.

2. Contract and Deposit: Bids may not be retracted once accepted by auctioneer. Upon being declared the top bidder the 10% buyer's premium will be collected. The successful bidder agrees to sign the contract of sale immediately following the auction. Terms are set forth in the contract of the sale, which is available for inspection, these are not negotiable upon being declared the winning bidder.

3. Conduct of Auction
a) Method and order of sale shall be at the sole discretion of the auctioneer
b) Bidding increments will be discretion of the auctioneer
c) Auctioneer reserves the right to add or delete a property from the auction
d) Auctioneer may change or modify the terms and conditions by announcement from the auction podium. Any such announcement shall take precedence over previously printed materials.
e) Bids will be accepted only from bidders that have duly registered in accordance with the terms and condition of sale.
f) The auctioneer's decisions relative to bidding increments, the order of sale, and any disputes between bidders will be final.
g) Telephone bids will be accepted. Bids will be accepted subject to all Procedures, terms and conditions of the sale. Bids must be delivered with a Money Deposit in advance of bidding.

4. Closing: The balance of the purchase price will be due and payable at closing. The contract of sale will provide for the contract to close within thirty (30) days of the auction event.

5. Conditions of sale: The property is being offered in "As-Is" condition.

6. Broker Participation: We welcome the participation of the Real Estate community in this important Auction! All registration letters must be received 24 hours prior to the auction by mail or fax (772) 468-9986. Registration Statement MUST Be received in the office of Jacobson Auction Company, Inc., 2103 Sunrise Blvd., Fort Pierce FL.

7. Agency Disclosure: Jacobson Auction Company, Inc., any cooperating Real Estate Brokers, and all licensees employed by or associated with the Auctioneer or Real Estate Broker representing the Seller in the sale of this property. Each bidder shall be deemed to have consented to the issuance of press release and other public communication by Auctioneer regarding the Auction and the properties offered or sold at the Auction. This Statement shall nor constitute an offer to sell or a solicitation of an offer to buy any of the Properties referenced herein. In addition, and without limitation of the foregoing, this statements shall not constitute an offer to sell or a solicitation of any offer to buy nor shall there be any sales of any of the Properties in any state in which such offer solicitation, or sale would be unlawful prior to the registration or qualification under the applicable security laws of the state.

8. Radon Gas: Radon is naturally occurring radioactive gas that, when it has accumulated in a building in sufficient quantities, may present health risks to persons who are exposed to it over time. Levels or radon that exceed federal and state guidelines have been found in buildings in Florida. Additional information regarding radon and radon testing may obtained from your county public health units. Pursuant to 404.D56(8) Florida Statues.

9. Lead Based Paint Statement: If property is a residential dwelling built prior to 1978 such property may present exposure to lead from lead based paint. Buyer has had a Ten (10) day opportunity before signing the offer to conduct a risk assessmet or inspection for the presence of lead based paint hazards or may within Ten (10) days from the effective date of the sales contract conduct a risk assessment or inspection for the presence of lead based paint hazards. If the results are unsatisfactory buyer may cancel this contract by written notice delivered to seller within Five (5) days from the date of the assessment or inspection.

10. Property guaranteed to have Free and Clear Title at Closing.
